The End of the Indochina War


1)All military hostilities shall cease and an immediate simultaneous cease-fire implemented throughout all of Indochina. A Joint Commission will be established between French, Vietnamese, Laotian, and Thai parties, responsible for the supervision of the cease-fire and the carrying out of its terms. Its cost, membership, and organization will be outlined in the attached documents. The completion of the terms outlaid below will mark the formal establishment of a state of genuine and permanent peace between the French Republic, Kingdom of Thailand, Buddhist Democratic Republic of Laos, and Buddhist Democratic Republic of Vietnam.
2)The Federation of French Indochina shall be dissolved. Its resultant territories uppon its dissolution shall consist of:
I.Buddhist Democratic Republic of Vietnam, formed from the former states of Annam, Cochinchina, and Tonkin, now re-united, in full independence from France.
II. Buddhist Democratic Republic of Laos, in full independence from France.
III. Cambodia, returned to the Kingdom of Thailand.
IV. Kouang-Tchéou-Wan, to remain as a French colony.
4)France shall renounce any and all claims to the territories of Vietnam, Laos, and Cambodia in respect to the governments now established there.
5)Any prisoners of war and civilian internees held by the French shall be returned to Vietnamese, Laotian, and Thai authorities within no more than 4 weeks, and any prisoners of war and civilian internees held by the Vietnamese, Thai, and Laotian authorities shall be returned to the French within nore more than 4 weeks.
I. The term "civilian internees" is understood to mean all persons who, having in any way contributed to the political and armed struggle between the two parties, have been arrested for that reason and have been kept in detention by either party during the period of hostilities.
6)Exceptions will concern those French prisoner of war troops identified as responsible for committing war crimes, which will be referred to the Justice Committee of the Joint Commission for trial, the Justice Committee including judges and delegates from Vietnam, Laos, Thailand, and France, as outlined in the attached documents. These troops will remain in Indochina or Thailand for the duration of these trials. The terms of this trial will be the same as that of the Leipzig War Crimes Trials, reflecting violations of international law agreements which have been signed by the French Republic.
6)French troops shall be evacuated from Vietnam, Laos, and Cambodia within a period not exceeding 6 weeks.
7)Any military installations, equipment, material, maps, and information will be left behind intact to Vietnamese and allied troops, except where they are necessary for evacuation of French forces as determined by the Vietnamese section of the Joint Commission with consultation from the French section. This shall include information on mines, booby traps, and explosive and dangerous devices. No violence or damages shall be occasioned to the civil population by either side during this period.
8)French administration, military and civil, will assist in the movement of Vietnamese, Thai, Laotian troops into territories formerly held by France, and Vietnamese, Laotian, and Thai administration, military and civil, shall assist French forces in their pacific and steady evacuation from Vietnam, Laos, and Cambodia. French aircraft shall follow the air corridors highlighted in the attached documents to their assembly points for evacuation, and troops shall follow the designated open roads, railroads, and waterways.
9)Immediately following the entry into force of this treaty, all types of arms, munitions and other war material, such as combat aircraft, naval craft, pieces of ordnance jet engines and jet weapons and armoured vehicles, shall be prohibited from entry into Vietnam except along the Vietnamese-Chinese land border, for the duration of the evacuation period.
10)The establishment of new military bases by French forces is prohibited for the duration of their remaining stay in Vietnam whiel their forces are evacuated.
11) A War Graves Committee shall be established by the Joint Commission, pending the establishment of a permanent body towards the management of French war graves in Indochina. Graves service personnel will be permitted to work in Vietnam under Vietnamese administration, for finding and properly managing deceased bodies of military personnel, there including deceased prisoners of war.
12)Under no circumstance will any blockade of Vietnamese, Thai, nor Laotian air, sea, or land routes be occasioned by French forces.
13)The French government shall renounce any and all financial claims for recompensation to former assets, possessions, and property within Vietnam, Cambodia, and Laos.
14)French citizens in Vietnam, Cambodia, and Laos will either have the option of abandoning their French nationality for the nationality of the respective country in which they inhabit, or having residence status as foreigners within the country. Their rights, responsibilities, and status shall be regulated according to Vietnamese, laotian, and Cambodian law.
15)France will renounce any extra-territorial privileges and statuses in Thailand, providing it full sovereignty and independence.
16)The French government agrees to the abandonment of any interests, sovereignty, or influence within Thailand, Laos, and Vietnam.
17)French educational, governmental, and administrational officials will be placed at the disposition of the Vietnamese, Thai, and Laotian governments in the event that they do not choose to leave the countries.
18.)The French, Thai, and Vietnamese versions of this text shall be equally legal. In any case of dispute between the three, the Disputes Committee of the Joint Commission will be responsible for their arbitration, as outlined in the attached documents.
